Will of Thomas Kerr

In the name of God Amen of Thomas Kerr of South Huntington Township Westmoreland County State of Pennsylvania farmer being weak in body and of sound mind memory and understanding But considering the uncertainty of the transitory life do make and publish this my last will and Testament in manner and form following to wit first it is my will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as eminiently can be after decease it is my wish that my Executor shall have suitable stones placed to make my grave as well as that of my present wife Item I give and bequeath unto my dear wife Mary the use of all my personal property for and during her natural lifetime Execpting one coult which I bequeath to my daughter Gavina and the residue of the horses I will and bequeath unto my son W. Stanton and further I bequeath unto my dear wife Mary the use of all my real estate during her natural lifetime she to have the entire controle and management as well as to receive all profits and issues arising from the same during her lifetime with this reservation that my son W. Stanton shall at all times have the privilage of cultivating my farm and to receive proper renumuration for the same Item I will and bequeath unto my son W. Stanton Kerr the one half part of my farm on which I now reside with the first choice should it be divided Item I bequeath unto my son Randolph the one fourth of my said farm and direct that he shall pay unto my step daughter Mary now intermarried with John Orr the sum of five hundred dollars Item I bequeath unto my daughter Lavina the one fourth of my said farm and diredt that she my daughter Lavina pay unto my son James the sum of fifty dollars and to pay unto my two Grand children Polly Finley and lucotta Finley the sum of twenty five dollars each the money directed to be paid unto Mary or by my son Randolph and the money directed to be paid unto my son James and my two grand children to be paid imeadtely after the decrease of my wife Mar and should my son Randolph never return from California to claim his legacies I will and bequeath his share unto my son W. Stanton and daughter Lavina to be equally divided between them provided they pay unto my step daughter Mary Orr the sum of five hundred dollars as Randolph was to do Item all of my personal property that my be on hand at the decease of my wife I will and bequeath that it shall be equally divided between my son W. Stanton and my daughter Lavina and lastly I nominate constitute and appoint my son W. Stanton and my daughter Lavina to be Executors of this my will hereby revoking all other wills legacies and bequests by me heretofore made declaring this and no other to be my last will and testament in witness whereof I have here unite Set my hand and seal 3rd day of July 1860 signed sealed declared and published by the above named Thomas Kerr as and for this last will and testament in the presence of us who at his request and in his presence have subscribed our names as witness thereunto.

Legally proved and approved this 6th day of July A.D. 1861 same day recorded and letters testamentary granted to W. Stanton Kerr and Lavina Kerr who was sworn before me.
